Welcome to Zamir Diamonds LLC (“Zamir Diamonds,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, online store, and related services (collectively, the “Services”). By accessing or using the Services, you agree to be legally bound by these Terms. If you do not agree, please do not use the Services.
 

1. Eligibility & International Use

Our Services are available only to individuals who can form legally binding contracts under applicable law. By using the Services, you represent and warrant that you are legally permitted to do so.

Zamir Diamonds ships internationally. All purchases and shipments are subject to applicable United States export laws, international trade restrictions, customs regulations, and economic sanctions, including regulations administered by the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC). We reserve the right to refuse, cancel, or restrict orders to any destination or individual where shipment or sale would violate applicable law or pose compliance, security, or risk concerns.
 

2. Use of the Services

You may use the Services only for lawful, personal, and non-commercial purposes. You agree not to:

• interfere with or disrupt the Services
• attempt unauthorized access to systems or data
• copy, scrape, or exploit website content
• misuse intellectual property or branding
• engage in fraudulent, deceptive, or unlawful conduct

Use of the Services does not grant you ownership of any intellectual property, including product images, designs, logos, trademarks, videos, or written content. All such materials are the exclusive property of Zamir Diamonds LLC.
 

3. Product Information & Accuracy

All product descriptions, specifications, measurements, carat weights, images, and prices are provided for informational purposes and are subject to change without notice.

Due to the nature of diamonds and gemstones, variations in appearance, inclusions, color tone, fluorescence, and other characteristics are inherent and are not defects. Product images may appear different depending on lighting conditions, screen settings, or magnification.

We do not guarantee that product descriptions or pricing are error-free and reserve the right to correct errors and cancel or refuse orders affected by such errors.
 

4. Orders & Acceptance

Your order constitutes an offer to purchase. Zamir Diamonds reserves the right to accept, decline, cancel, or limit any order at its sole discretion, including after an order confirmation has been issued.

Prices do not include applicable taxes, duties, customs fees, shipping, or handling unless explicitly stated.
 

5. Shipping, Delivery & Risk of Loss

Title and risk of loss pass to you upon transfer of the product to the shipping carrier or upon personal delivery. Delivery dates are estimates only and are not guaranteed. Zamir Diamonds is not responsible for delays caused by carriers, customs authorities, incorrect shipping information provided by you, or events beyond our reasonable control. You must inspect your order immediately upon delivery. Any claims for damage must be reported within twenty-four (24) hours of delivery.
 

6. Returns, Exchanges & Custom Orders

All sales are subject to Zamir Diamonds’ Return & Exchange Policy, which is incorporated by reference and may be updated from time to time.

Unless expressly stated in writing by Zamir Diamonds, we do not offer repair, resizing, or alteration services. Any assistance offered, if any, is provided at our sole discretion and does not create an ongoing obligation. Custom, personalized, engraved, altered, resized, made-to-order, special-order, sale, and final-sale items are non-returnable and non-exchangeable.
 

7. Payment

You authorize Zamir Diamonds to charge your selected payment method for all purchases. You are responsible for all charges incurred under your account.

We reserve the right to suspend or cancel orders, accounts, or access for failed payments, suspected fraud, chargebacks, or misuse. You agree to reimburse collection costs and fees permitted by law.
 

8. Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED IN WRITING, ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZAMIR DIAMONDS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
 

Natural diamonds and gemstones contain inherent characteristics and variations that are not considered defects.
 

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZAMIR DIAMONDS SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY CLAIM, LOSS, DAMAGE, OR EXPENSE ARISING OUT OF OR RELATING TO THE PRODUCTS, SERVICES, OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE.

IF, NOTWITHSTANDING THE FOREGOING, ANY LIABILITY IS IMPOSED BY A COURT OF COMPETENT JURISDICTION, SUCH LIABILITY SHALL BE LIMITED TO ONE HUNDRED U.S. DOLLARS (US $100).

IN NO EVENT SHALL ZAMIR DIAMONDS BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF VALUE, OR LOSS OF USE.
 

10. Third-Party Content & Links

The Services may contain links to third-party websites or content. Zamir Diamonds does not control and is not responsible for third-party content, policies, or practices. Accessing third-party services is at your own risk.
 

11. Indemnification

You agree to indemnify and hold harmless Zamir Diamonds LLC and its owners, officers, employees, and agents from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, misuse of the Services, or violation of applicable law.
 

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles.
 

13. Binding Arbitration & Class Action Waiver

Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration under the Federal Arbitration Act.

YOU AND ZAMIR DIAMONDS WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS, COLLECTIVE, OR REPRESENTATIVE ACTIONS. Each dispute shall be resolved on an individual basis only.
 

14. Modifications

Zamir Diamonds may update these Terms at any time. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
